Spain–China

Contracts, companies, trademarks and disputes between Spanish and Chinese companies, with lawyers who know both sides and a native Chinese team.

What we do

  • Drafting and review of sale, distribution, agency and manufacturing contracts with Chinese companies
  • Incorporation of companies and subsidiaries in Spain for Chinese businesses
  • Setting up in China: company or representative office
  • Registration and protection of trademarks in China before exporting
  • Tax and customs aspects of transactions
  • Negotiation and recovery of unpaid amounts and breaches with Chinese counterparties

If your company is Chinese

We help you incorporate your company in Spain, open a bank account, hire staff and comply with the tax and social security authorities, with a team that speaks to you in Chinese. If your business is trading, EurochinaBridge takes care of the goods and the logistics.

If your company is Spanish

Before signing with a Chinese supplier or distributor, it is worth checking who they are, registering your trademark in China and agreeing the right governing law, court and payment terms. We review it before there is a problem, and if there already is one, we negotiate in their language.

How we work

Each matter is handled by one of the firm's lawyers with the support of the Chinese team, who speaks to the counterparty in its language. When the deal has a commercial or logistics side, it is coordinated by EurochinaBridge, the group's trading company.

Before signing with a Chinese supplier, check who they are, which trademark they have registered and which law and court will apply.
Can you review a contract written in Chinese?

Yes. The Chinese team translates and reviews the text, and the lawyer proposes the changes in both languages.

Which law should we agree with a Chinese company?

It depends on the transaction and on where each party's assets are, because that is where any judgment or award will have to be enforced. We assess it case by case before signing.

Do I need to register my trademark in China if I only sell there through a distributor?

It is highly advisable. China follows a first-to-file system: whoever registers a trademark first usually keeps it, even if they did not create it.

Do you have a deal with China under way?

We review the contract or the problem before it is too late.
